Purpose                                                                   

The Committee of Adjustment is a quasi-judicial body that considers applications for minor variances, consents and validation certificates pursuant to the Planning Act

A minor variance application is required when a proposed project requires relief from the Town’s Zoning By-law provisions such as building height (maximum), driveway width (maximum) or rear yard set-backs (minimum).

A consent application is required when a property owner wants to sever a portion of their lot to create a new lot or adjust a lot line.

Apply Online

You have an opportunity to discuss your proposal with staff before submitting an application. This may help reduce delays and cost.

When you submit the online form, a copy of the form and all submission material is sent to you as the Applicant and Town staff. Town staff will contact you to discuss the application and obtain payment.

 Application Submission Process

1. Review the Minor Variance Application Manual or Consent Application Manual

2. Request a Preliminary (PARC) Meeting to review your application with planning staff prior to submitting the application. 

3. Complete and submit the application form, you will require the following:

  • Contact information, including name, address, phone number and email address (as identified on their government-issued I.D.) for the property owner(s) and agent (if applicable) 
  • Preliminary Meeting Date and Town Staff Names 
  • Property information such as:
    • municipal address,
    • roll number/ARN, 
    • legal description, 
    • Greenbelt Plan designation, Niagara Escarpment Plan designation and/or Oak Ridges Moraine Conservation Plan designation
    • Region of Peel Official Plan designation
    • Town of Caledon Official Plan designation
    • Zoning of the property and the applicable Zoning By-law Number (i.e. Zoning By-law 2006-50, Zoning By-law 87-250, or other site specific by-law)
    • If the property is regulated by a Conservation Authority and if so, which Conservation Authority
    • The planning applications applicable to the property including the status and file number
  • Supporting material and documentation in PDF format:
    • Site Plan or Sketch Plan
    • Legal Opinion (for a Validation Certificate)

4. The Secretary-Treasurer will contact you to confirm receipt of the application and to arrange payment for all associated fees.

5. Following the submission of the 'complete' application the Secretary-Treasurer will contact you with a hearing date.

Please note: An application is only deemed 'complete' when it has been commissioned and payment of all associated fees and submission of all material required by agencies and departments has been received.

 Hearing Process
  1. Once the application is deemed 'complete' the Secretary-Treasurer will provide you with a hearing date and confirm if you are participating in-person or remotely at the hearing.  If you choose to participate remotely, you will receive an email containing the Cisco WebEx meeting invitation.

  2. The hearing agenda will be published one (1) week prior to the hearing date and can be accessed through the Council and Committee Calendar on the Town's website. 
  3. At the hearing, you, the applicant, or your agent will be provided an opportunity to provide any new information regarding the application not previously submitted to the Town.  

  4. The Committee will be provided an opportunity to ask questions about the application and receive responses from Town staff and/or the applicant.

  5. Members of the public will be provided an opportunity to make verbal and written submissions regarding the application.

  6. The Committee will make a decision on the application. 

  7. Following the hearing the Secretary-Treasurer will issue a notice of decision, you will receive the notice of decision via  mail.
 Appeal Process
  1. Following a hearing, the Secretary-Treasure will issue a notice of decision for each application. The applicant, the Minister of Municipal Affairs and Housing, and certain public bodies or persons specified by the Planning Act may, within 20 days of the making of the decision, appeal to the Ontario Land Tribunal (OLT) against the decision of the Committee. 
  2. Appeals may be submitted by filing in writing through the e-file portal, or by email or letter mail, outlining the reasons for your case under the relevant legislation and accompanied by payment of the fee prescribed by the Tribunal under the Ontario Land Tribunal Act to the Secretary-Treasurer of the Committee.
  3. Following the submission of the notice of appeal and associated fees, the Secretary-Treasurer of the Committee of Adjustment and the Ontario Land Tribunal will contact you with additional details.

Purpose: The applicant is requesting relief from the Town of Caledon Zoning By-law 2006-50, as amended, for the following variances:

  1. To permit a Contractor’s Facility and associated accessory uses as outlined in the A3-T12 Zone on the entirety of the subject lands, except for the portions of the lands zoned EPA-T11, for a temporary period of time ending on April 30, 2027.              

A 001-25 - 6141 Old Church Road

Purpose: The applicant is requesting relief from the Town of Caledon Zoning By-law 2006-50, as amended, for the following variances:

  1. To permit a Special Care Home use on the property, whereas the By-law does not permit a Special Care Home in the Rural Residential (RR) Zone.
  2. The provisions of Section 5.2.7 of Caledon Zoning By-law 2006-50, as amended, shall not apply.
  3. The provisions of Section 5.2.12 of Caledon Zoning By-law 2006-50, as amended, shall not apply.
  4. To permit a total of five (5) parking spaces for the Special Care Home use, whereas the By-law requires a minimum of six (6) parking spaces for the Special Care Home use.

A 003-25 - 0 Castlederg Side Road

Location: 0 Castlederg Side Road

Nearest Intersection: Castlederg Side Road and The Gore Road, Ward 3

Purpose: The applicant is requesting relief from the Town of Caledon Zoning By-law 2006-50, as amended, for the following variances:

  1. To permit a Building Height of 12.04 metres (39.5 feet), whereas the By-law permits a maximum Building Height of 10.5 metres (34.44 feet).
  2. To permit a Driveway Width of 19.04 metres (62.46 feet), whereas the By-law permits a maximum Driveway Width of 10.0 metres (32.8 feet) for a lot with a lot frontage of 18.0 metres (59.05 feet) or greater.

Purpose: The applicant is requesting relief from Zoning By-law 2006-50, to permit:

  1. A total of three (3) bedrooms within an Additional Residential Unit, whereas the By-law permits a maximum of two (2) bedrooms.

Purpose: The applicant is requesting relief from the Town of Caledon Zoning By-law 2006-50, as amended, for the following variances:

  1. To permit a Stormwater Management Facility as a permitted use on the lands zoned Environmental Policy Area 2 (EPA2). The subject lands are associated and described within lot line adjustment Consent Application B 003-25.

A 052-24 - 13540 Caledon King Townline South

Location: 13540 Caledon King Townline South

Nearest Intersection: Caledon King Townline and King Street East, Ward 6

Purpose: The applicant is requesting relief from the Town of Caledon Zoning By-law 2006-50, as amended, for the following variances:

  1. To permit a maximum of 150 units within the RT-618 Zone, whereas the By-law permits a maximum of 140 units within the RT-618 Zone.
  2. To permit a minimum Lot Frontage for interior lots of 5.6 metres, whereas the By-law permits a minimum Lot Frontage for interior lots of 6.0 metres.
  3. To permit a minimum Lot Frontage for corner lots of 6.0 metres, whereas the By-law permits a minimum Lot Frontage for corner lots of 7.0 metres.
  4. To permit a minimum Lot Area for interior lots of 140m2, whereas the By-law permits a minimum Lot Area for interior lots of 150m2.
  5. To permit a minimum Backyard Amenity Area of 25m2, whereas the By-law permits a minimum Backyard Amenity Area of 37m2.
  6. To permit a minimum Front Yard Setback for a corner unit of 2.2 metres, whereas the By-law permits a minimum Front Yard Setback for a corner unit of 3.5 metres.

 

Consent Applications

B 001-25 - 8 Victoria Street

B 01-25 - 8 Victoria Street East

Location: 8 Victoria Street East

Nearest Intersection: Victoria Street East and King Street, Ward 1

Purpose: The applicant is proposing to sever the property into two separate lots; Lot 1 being the retained lands which contains an existing detached dwelling, and Lot 2 being the severed lands for the development of a proposed 2-storey single-detached dwelling. Access to all properties are to be provided from Victoria Street East.

The Retained Lands will contain a Lot Area of 1,428m2 and a Lot Frontage of 37.56 metres.

The Severed Lot #1 will contain a Lot Area of 10,117.14m2 and a Lot Frontage of 82.08 metres.

B 002-25 - 8 Victoria Street East 

Location: 8 Victoria Street East

Nearest Intersection: Victoria Street East and King Street, Ward 1

Purpose: The applicant is proposing to sever the property into two separate lots; Lot 1 being the retained lands for the development of a proposed 2-storey single-detached dwelling, and Lot 2 being the severed lands. Access to all properties to be provided from Victoria Street East.

The Retained Lot will contain a Lot Area of 2,189.27 sq m2 and a Lot Frontage of 57.59 metres.

The Severed Lot #2 will contain a Lot Area of 7,593.68m2 and a Lot Frontage of 30.58 metres.

Purpose: The applicant has filed a consent application to allow for a lot line adjustment that would permit the expansion of adjacent lands (described as Block 1 on Draft Approved Plan of Subdivision 21T-12005C) by approximately 1.2 acres. Minor Variance Application A 005-25 is associated with the subject application, to request permission for a Stormwater Management Facility as a permitted use on these lands.

Decisions made by the Committee of Adjustment may only be appealed by the applicant, the Town of Caledon, certain public bodies or persons specified by the Planning Act and the Minister of Municipal Affairs and Housing upon receipt of a Notice of Decision.
